General Zoning & Permitting

Zoning is a tool used by the City to manage land use, protect public health and safety, and guide orderly development. The Backus Land Use and Subdivision Ordinance establishes rules for how land and buildings can be used, sets standards for construction, and outlines the permitting process.

Permits: When Are They Required?

Setbacks and specific requirements differ significantly from one Zoning District to another, depending on various factors. To find out what applies to your property, it is best to contact City Hall or the Zoning Administrator or consult the Ordinance directly. At the end of this document, you will find a link to the Ordinance as well as contact details.

Permits are required for new structures, additions, changes to structure dimensions, construction or repair of sewage systems, and grading/filling in shoreland areas (unless exempted). Projects like decks, garages, sheds, fences, and major remodels typically require permits.

Common exemptions include replacing shingles or siding (if not altering the structure), painting, flooring, cabinets, window replacement, replacing of railings or single decking boards, and routine landscaping.

Camping, RVs, and Campers

Yes, but there are specific standards: Properties with a principal structure: Up to 4 camping units allowed at any time, but no individual unit may be placed for more than 14 days within any 60-day period. One unit may be stored year-round. Properties without a principal structure: Up to 4 units allowed at any time. Each unit may be placed for up to 14 days per calendar year without a permit. For longer stays (up to 9 months), a permit is required and a permanent sewage treatment system must be installed. Only one permit per parcel per year is allowed. During construction of a principal structure: Camping units are allowed for up to 12 months (with possible extension).

All RVs/campers must be designed to operate on state roads without a special permit and have a current license. They must not be permanently placed or skirted, must be readily movable, meet dwelling setback requirements, and have written permission from the property owner if the owner is not present.

For long-term placement (over 14 days), a permanent sewage treatment system must be installed. Short-term camping does not require this, but all waste must be properly managed.

Common Zoning Questions

Yes, all fences up to 72 inches (6 feet) require a permit and may be constructed on a property line (except within waterfront setback areas). Taller fences require a Conditional Use Permit.

Exterior storage is not allowed on lots without a principal or accessory structure. On lots with structures, materials, and equipment must be stored inside or fully screened. Abandoned vehicles must be stored inside or screened.

Most signs require a permit, except for political, government, and certain temporary signs. Residential signs are limited in size and lighting.

Permit applications can be found on our website or are available from the City Clerk. Submit completed forms, pay the required fee, and provide any supporting documents (site plan, survey, etc.). The Zoning Administrator reviews applications for compliance.

Variances & Conditional Use Permits

You may apply for a variance if strict enforcement would cause undue hardship due to unique circumstances. Conditional Use Permits are required for certain uses not permitted by right. Both require public notice and review by the Planning Commission and City Council.

Enforcement & Complaints

Complaints must be filed formally with the City Clerk, the complaint form can be found online, or the City Clerk can provide you with one. The Zoning Administrator investigates and may issue enforcement letters. If unresolved, the matter may be referred to the City Attorney.
